Liability Waiver and Release

  1. Assumption of Risk Users of the Hub Split LLC platform, accessible via hubsplit.com, acknowledge that the buying, renting, or using of any products, services, or items from our platform involves inherent risks that may cause personal injury, property damage, or other forms of loss. Users assume full responsibility for these risks, both known and unknown.
  2. Waiver and Release of Claims By agreeing to these Terms of Service, users expressly waive and release any and all claims, now known or hereafter known in any jurisdiction throughout the world, against Hub Split LLC, and its officers, directors, employees, agents, affiliates, shareholders, successors, and assigns (collectively, “Releasees”), on account of injury, death, or property damage arising out of or attributable to the use of our platform, whether arising out of the negligence of Hub Split LLC or any Releasees or otherwise.
  3. Indemnification Users agree to indemnify, defend, and hold harmless the Releasees from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorney fees, that are incurred by Releasees arising out of or related to the users’ use of the platform, products, or services.
  4. Limitation of Liability To the maximum extent permitted by law, Hub Split LLC shall not be liable to any user or any third party for any indirect, incidental, special, exemplary, punitive, or consequential damages of any kind, or any damages whatsoever, including, but not limited to, damages resulting from injury to person or property or from any use of any product, service, or item obtained from Hub Split LLC, whether based on warranty, contract, tort (including negligence), or otherwise, even if Hub Split LLC has been advised of the possibility of such damages.
  5. Insurance Hub Split LLC expressly disclaims any liability or provision of insurance coverage for personal injury, property damage, or theft that may occur during the use of our services or facilities. All clients and participants acknowledge that they are responsible for obtaining their own insurance to cover such risks.
  6. Acknowledgment of Understanding Users confirm that they have read this Liability Waiver and Release and fully understand its terms. Users acknowledge that they are giving up substantial rights, including their right to sue. Users are agreeing to these terms freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law. Users agree that if any portion of this agreement is held to be invalid, the remainder shall continue in full force and effect.
